Terms and Conditions of Sale

These General Terms and Conditions govern the sale of products marketed by MoveUp Store – Zandonà Srl through the website www.moveup-store.com. Purchases are permitted both to consumer customers (B2C) and to professionals or companies (B2B). For consumers, the provisions of Legislative Decree 206/2005 (Italian Consumer Code) apply.

1. Subject of the contract

This contract concerns the sale of lifting equipment, forklifts and related accessories.
Submitting an order implies full and unconditional acceptance of these General Terms and Conditions of Sale.

1-bis. Order acceptance

MoveUp Store – Zandonà Srl reserves the right, at its sole discretion, to accept or refuse any order received, even after the automatic confirmation sent by the system, without obligation to provide justification and without giving rise to any right or claim by the purchaser.

2. Prices and payments

All prices indicated on the website are expressed in Euros and include VAT unless otherwise specified. Payments may be made by credit card, PayPal, bank transfer or other methods indicated on the website. The contract is considered concluded once payment has been confirmed by the system.

3. Shipping and delivery

Shipments are normally processed within 72 working hours for Italy and 120 hours for European Union countries.
Any delays not attributable to MoveUp Store shall not entitle the customer to any compensation or indemnity.

4. Right of withdrawal

The right of withdrawal is granted exclusively to consumers in accordance with the Consumer Code. The withdrawal period is 14 days from receipt of the goods. Returns are free of charge for private customers.
This right does not apply to professionals or companies (B2B).

5. Warranty

Products are covered by a legal warranty of conformity lasting 24 months for consumers and 12 months for companies. The warranty covers only the structural parts of the supplied goods and does not extend to moving parts or components subject to normal wear. Replacement of defective components will be carried out by sending spare parts. Any on-site interventions will be evaluated on a case-by-case basis, subject to completion of the appropriate request form and written authorization from Zandonà Srl. The Customer is required to return the parts replaced under warranty to MoveUp Store – Zandonà Srl for technical verification. Failure to return the replaced parts will result in the Customer being charged the corresponding list price. The warranty does not include labor costs or travel expenses of technical personnel, unless expressly authorized in writing by the Company.

6. Limitation of liability

MoveUp Store – Zandonà Srl shall not be held liable for direct or indirect damages resulting from improper use of the products, maintenance not compliant with the instructions, force majeure events or interruptions of the website service. In any case, the Company’s total liability shall not exceed the amount actually paid for the purchase of the product.

7. Jurisdiction

For any dispute, the Court of Treviso, Italy, shall have exclusive jurisdiction.
